Terms of Service
Effective Date: September 2026 • Miami Diesel Works LLC
1. Service Authorizations & Diagnostics
By authorizing Miami Diesel Works LLC to inspect, diagnose, overhaul, or dispatch mobile rigs for your commercial motor vehicle or marine vessel, you authorize our certified technicians to operate the equipment for testing, inspection, or delivery purposes. Computer diagnostic fees and initial inspection fees apply to all service engagements unless explicitly bundled within a contracted major overhaul agreement.
2. 24/7 Mobile Roadside & Dockside Dispatch Terms
For emergency highway breakdown calls (e.g. I-95, Florida Turnpike, SR-826 Palmetto) and dockside marine dispatches:
- Safety Protocols: Highway callouts require drivers to position units safely off active traffic lanes or coordinate with Florida Highway Patrol / Road Rangers prior to mechanic arrival.
- Marina Access: Customers requesting dockside marine service warrant that our mobile service crew is granted legal access to the vessel slip, dock facilities, and marina power connections.
- Callout & Mileage Fees: Dedicated mobile unit deployment charges, portal-to-portal travel, and emergency after-hours dispatch surcharges will be clearly quoted prior to technician rollout.
3. Estimates, Change Orders & Hidden Mechanical Defects
Initial estimates reflect visible symptoms and OEM scan tool data. Major engine overhauls (in-frame/out-of-frame) or extensive marine heat exchanger teardowns may uncover pre-existing metal fatigue, cracked cylinder heads, worn camshaft lobes, or saltwater electrolysis damage. Any additional parts or labor required beyond original written estimates will be submitted to the client for digital or written approval before proceeding.
4. Payment Terms & Commercial Fleet Accounts
Payment in full is due upon completion of services and prior to vehicle release or vessel sea-trial sign-off, unless a formalized commercial credit term has been executed in writing.
We accept: Major Credit Cards (Visa, MasterCard, Amex, Discover), Cash, Fleet Checks, Comdata, EFS, and T-Chek. Commercial fleet accounts are subject to Net-15 or Net-30 invoicing upon credit underwriting approval.
5. Florida Mechanic's Lien & Vehicle Storage
In accordance with Florida Statutes Chapter 713 (Part II), an express mechanic's lien is acknowledged on all vehicles, vessels, engines, and equipment to secure the amount of repairs and materials furnished. Units not picked up within forty-eight (48) hours of written completion notice may be subject to reasonable daily yard storage charges.
6. Limitation of Liability
Miami Diesel Works LLC shall not be liable for incidental, indirect, or consequential damages, including loss of cargo, commercial revenue downtime, charter cancellations, or lodging expenses resulting from mechanical delays, parts backorders from OEM suppliers, or acts of God.
7. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the State of Florida. Any legal action or dispute arising from services performed shall be resolved exclusively in the state or federal courts situated in Miami-Dade County, Florida.
